EXHIBIT D <br />MINING PLAN <br />(A) Mining of the sand and gravel deposits is scheduled to commence approximately <br />May 1, 2003. <br />(B) Topsoil should be stockpiled during mining operations and later reapplied after <br />slopes have been shaped to aid in re-establishing vegetation. Topsoil stockpiling <br />will be approximately 2,000 cu/yds. The topsoil stockpiles will strategically be <br />located adjacent to the current mining operation and will be adequately <br />disseminated and reclaimed as mining occurs. <br />(C) Following mining operations, slopes should be shaped to 3:1 or flatter. Small <br />areas of 2:1 slopes aze often unavoidable but should be kept to a minimum. <br />(D) An already existing access/haul road that runs through the center of the present <br />permitted mining azea will remain and will be utilized by road and bridge <br />employees for the purpose of transporting culverts to the existing storage azea <br />located in the southwest corner of the mining azea. <br />(E) There will be no additional structures erected in addition to the existing haul road <br />and storage azea. <br />(F) Sand and gravel material may be stockpiled or loaded directly on to county <br />trucks for use on county roads only. <br />(G) A possible haul road will be developed along the existing northern boundary, <br />(which is the old abandoned roadway) that will allow for access to the active <br />mining area. The haul road may need periodic grading to accommodate heavy <br />truck traffic. <br />(H) There will be no water used in conjunction with mining operations. <br />(I) The gravel pit will not intercept any groundwater due to its slope and runoff. <br />Runoff water from the site or adjacent azeas must be controlled with diversions <br />or similar structures to prevent serious erosion and damage to the planting. <br />Ponds of water may occur for a short period of time after a significant rainfall, <br />yet no detrimental effects are anticipated. <br />(J) Applicable water laws should not be affected. Cheyenne County, as a political <br />subdivision of the State of Colorado, will always adhere to applicable Colorado <br />water laws. <br />
