I have ordered my responses by the original question numbers
that were remaining as outstanding.
North Soil Storage Area
20. (b) Response accepted.
(c) Response accepted. The operator maintains that the pond is an incised
pond and is not subject to the requirements of 4.06.5(11) regarding embankment
design. If you are comfortable that the pond is indeed an incised pond with no
constructed embankment, then I have no further questions.
This concludes my review of MCC's responses. Please let me know if you have any
questions.
CC: Dan Hernandez
M:/coal/kag/westelktr86a
