Box 161 <br />Silt, Colorado 81652 <br />RE: Review of Stipulation Responses to Permit for the Eastside Mine - <br />File No. C-84-063 <br />Dear Mr. Self: <br />The Division has reviewed your recent stipulation response submittals for the <br />above described operation. Comments specific to each stipulation are <br />presented below. <br />Stipulation No. 2 <br />The permittee will submit to the Division a design to provide for <br />non-clogging operation of the orifice in Pond SP-2 within 30 days of <br />permit issuance. <br />Comment: The design submitted for a non-clogging orifice in Pond SP-2 <br />satisfies Stipulation No. 2. <br />Stipulation No. 3 <br />The permittee will present to the Division a plan whereby the 60 <br />percent sediment volume level can be marked on Ponds SP-1 and SP-2. <br />This plan should be submitted within 60 days of permit issuance. The <br />ponds will be maintained with sediment level at or below this level. <br />Comment: The request for extension of the compliance date of Stipulation <br />No. 3 is granted based on the fact that the ponds in question have <br />not yet been constructed. The revised time frame for submittal of <br />the plan far arking the 60 percent sediment volumes on Ponds SP-1 <br />and SP-2 30 is days prior to pond construction. <br /> <br />423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel.
