None of the boreholes were drilled deep enough to determine the <br />thickness of this unit. <br />The reclamation plan in the west upland mining area includes using the overburden removed <br />in the stripping phase of the mining plan to backfill. The west upland azea will be covered <br />with a minimum of 12 inches of overburden. Boreholes indicate the average thickness of the <br />overburden is four feet. <br />In addition to a commitment of a minimum backfilling depth of 12 inches, the lease <br />agreement with the State Land Board states the final topography must not be more than 25 <br />feet below the existing grade (see page D-2 of the application). In order to maintain this <br />agreement, the operator will not be able to mine the entire depth of the deposit in some areas. <br />Therefore, these areas will not expose the underlying strata and there will be more overburden <br />available for backfilling azeas that do expose the clay. <br />5) We have made the adjustment to page E-2 and have enclosed a new copy. <br />6) The City of Aurora has dropped their formal objection with the Division and it is no longer an <br />issue to resolve. <br />We are in the process of working out an agreement with the Urban Drainage and Flood <br />Control District.
