Thus faz, groundwater level measurements taken on the upland terrace <br />(outside of the Coal Creek drainage) indicate the groundwater level is about four to five feet <br />below the surface. Measurements have also shown seasonal fluctuations in the groundwater <br />level. Therefore, we believe there is not enough baseline data to make any conclusions about <br />the pre-mining groundwater levels. More baseline data will be collected before lowland <br />mining begins this spring. <br />Exhibit C includes the exact locations of the monitoring well transects. Enclosed is a copy of <br />Exhibit C. <br />The monitoring frequency and reporting will be increased to two times a year. The <br />measurements will be submitted with the annual report. <br />3) Enclosed is a copy of [he letter sent to us by Public Service Company. They have given <br />permission to mine within 100 feet of their powerline. If necessary, the powerline will be <br />relocated a[ the expense of the operator. <br />We have been unable to formulate an agreement with Central Resources, Inc., but we will <br />continue to pursue with negotiations until an agreement is reached or make adjustments in the <br />mining plan. <br />The Division's Adequacy Review states "...unless the necessary compensation agreements <br />are reached with... Central Resources Gas Company with regard to mining within 200 feet of <br />their permanent structures... DMG will only grant a Conditional permit." The letter also <br />states "... no mining_can take place until the legal issues and permission to mine aze obtained <br />from the interested parties which own the structures within 200 feet of the mining in writing, <br />or an engineering study which proves that there will be no negative impacts from the mining <br />on the structures." <br />We take these two statements to mean no mining can take place until the condition is met, <br />even if mining occurs at a distance greater than 200 feet from Central Resource's pipeline. <br />We believe the permit should be issued with the following condition: <br />"No mining activity can take place within 200 feet of Central Resource's gas pipelines until a <br />compensation agreement is obtained, or an engineering study p~es there will be no negative <br />impacts from the mining on the structures." ~...anl~yo <br />
