David Berry
July 9, 1990
Page 11

RESPONSE:
Please refer to Minor Revision 90-10 (hydrologic Monitorying Plan), recently
submitted by CYCC, for the requested information.
MLRD CONCERN:
8. Please add an Exhibit which contains the information regarding the
Phase I bond release, and which incorporates the four maps/drawings
associated with the release (Maps 1 of 3, 2 of 3, 3 of 3 Partial Bond
Release, Postmining Topo Cross Section).
RESPONSE:
As the requested information is not required under current regulations, CYCC
respectfully declines to create an exhibit addressing these items.
MLRD CONCERN:
PERFORMANCE STANDARD ISSUES
1. As previously discussed, please submit a revision which discusses the
status (permanent or temporary) and morphometry of the drainage ditches.
RESPONSE:
CYCC wishes to address this matter separately by means of a Technical
Revision, as per our previous discussion with the Division.
MLRD CONCERN:
2. The permit document does not seem to address the permanent overburden
pile. The document must reflect its existence and the design
parameters associated with it. Have we missed something? Your
assistance will be appreciated.
RESPONSE:
Upon review of pertinent correspondence, it appears that the permanent
overburden pile was exempted from certification by the Division under the
76-16 permit, due to interim regulations being in force at time of
construction. Page 2.05-67 which states the location of the Permanent
Overburden Stockpile has been revised to address the certification exemption
by the Division.
MLRD CONCERN:
3. We will be conducting a separate review of the CHIS and analysis will
be forthcoming.
MLRD CONCERN:
1. Please submit revised pages to incorporate Minor Revision No. 1.
