For example, the renewal
"permitted" acreage is given as 1405.4, whereas the existing document
indicates permit acreage of 1357. The affected acreage values given in
the renewal application and existing document are 358.8 acres and 382.0
acres, respectively, The reclaimed acreage (368) is larger than the
affected acreage (358.8), as provided on the application form. The
disturbed acreage must include all of the reclaimed land which is not
yet released (Rule 1.04.(36), thus it cannot be 1.9 acres. The bond
release acreage values of 358 (Phase I) and 100.2 (Phase III) also seem
to be inconsistent with the other values.
Please check all maps and survey information, and then provide accurate
acreage information.
RESPONSE:
After reviewing pertinent maps and survey information, CYCC has determined
the following acreages are representative of the Mine 3 permit area.
Permitted Acreage: The existing document, (submitted in 1984) gives this
value as being 1357 acres. However, this would appear to be a typographical
error since the legal description as submitted encompasses some 1397 acres.
Additionally, about 11 acres were omitted from the legal description. When
the 40 acre and 11 acre discrepancies are added to the 1357, a total permit
acreage of some 1408 acres is obtained. The difference between 1408 acres
and the 1405 acre value submitted with the permit renewal application can be
attributed to rounding error. The revised complete legal description (page
2.03-38a') has been enclosed.
Affected Acrea e: The existing document gives this value as being 38.0
acres from CMLRD Table #7), while the permit renewal application stated this-
