Please complete and return <br />with the operator's original (not photocopied) signature. <br />Item Number 14 - Application Fee <br />A check in the amount of $2,000.00 was received by the Division on August 2, <br />1985. Pursuant to Rule 1.8, C.R.S. 34-32-112(8), "In no case shall the <br />renewal or amendment fee be more than one thousand dollars." and Rule <br />1.102, "Conversion Fees will be the same as rule 1.8". A $1,000.00 refund <br />will be returned to Robinson Brick Company under separate cover. <br />Exhibit C - Pre-Mining and Mining Plan Map <br />1. Please provide Map C and D-1 illustrating location of the Apache 9 <br />(M-78-009) and Apache 9A (M-78-O10) mine sites within the new proposed <br />permit boundaries. <br />2. Please indicate which pre-law disturbance(s) is (are) planned for <br />"redisturbance" and subsequent reclamation. <br />3. Pursuant to C.R.S. 34-32-115(4)(d): <br />"(4) The board shall grant a permit to an operator if the application <br />complies with the requirements of this article and all applicable <br />local, state, and federal laws. The board shall not deny a permit, <br />except for one or more of the following reasons: <br />(d) The mining operation will adversely affect the stability of any <br />significant, valuable, and permanent man-made structures located <br />within two hundred feet of the affected land, except where there <br />is an interest in the structure that damage to the structure is <br />to be compensated for by the operator." <br />Please provide an agreement between Robinson Brick Company and 1) the owner of <br />the farmhouse, 2) owner of the "several outbuildings"t 3) the power company, <br />and 4) the Colorado Division of Highways indicating A/ the minimum distance <br />required to be maintained between "affected land" and "pertinent <br />structure(s)"; and, B) mitigation measures proposed by Robinson Brick Company <br />if damage to the pertinent structure(s) is caused by mining-related activities. <br />Exhibit D - Mining Plan <br />It was stated that "overburden will be used for backfilling and sloping <br />wherever needed." What will be done with the material where it is not <br />needed? <br />2. Overburden stockpiles should be handled similarly to topsoil stockpiles, <br />i.e., they should be graded to slopes no steeper than 3H:1V, and if <br />stockpiled over a growing season, with a cover crop for conservation <br />purposes. <br />3. Will the "Badlands" be mined? <br />
