ALL MONITORING MUST CONTINUE UNTIL DISCONTINUATION IS APPROVED <br />BY THE DIVISION IN WRITING. <br />Stioulation No. 15 <br />THE PERMITTEE SHALL SUBMIT AN ANNUAL HYDROLOGIC MONITORING <br />REPORT FOR THE NEW ELK MINE. THE MONTI'ORING REPORT SHALL INCLUDE <br />A SUMMARY AND ANALYSIS OF DATA COLLECTED DURING THE YEAR, <br />INCLUDING: 1) WATER USED IN THE MINING OPERATION; 2) MINE WATER <br />DISCHARGES TO RECEIVING STREAMS (QUANTITY AND QUALITY); 3) MINE <br />WATER INFLOWS (ANNUAL MINE INFLOW STUDY); 4) STREAM FLOWS AND <br />QUALITY; 5) IMPACTS TO THE QUALITY AND QUANTITY OF ALLUVIAL AND <br />BEDROCK AQUIFERS; AND 6) IMPACTS TO SPRING FLOWS AND QUALITY. THE <br />MONITORING REPORT SHOULD INCLUDE A DESCRIPTION OF MITIGATNE <br />MEASURES TAKEN TO MINIMIZE DISTURBANCE TO THE PREVAILING <br />HYDROLOGIC BALANCE. <br />Section IV <br />Enforcement Actions <br />This section is a review of the enforcement actions issued since the last permit renewal (RN- <br />02) in March of 1994. No enforcement actions are currently outstanding. <br />NOV #C-94-018 <br />This violation was issued for failure to pass disturbed area drainage through a sediment pond or <br />treatment facility. The violation was ultimately vacated by the Board on December 14, 1994. <br />NOV #C-94-019 <br />This violation was issued for failure to maintain ditches and culverts. It was vacated on August <br />12, 1994 by the Director. <br />NOV #C-94-020 <br />This violation was issued for failure to dispose of non-coal waste in a non-coal waste disposal <br />area. A request for vacation of this NOV was denied by both the Coal Program supervisor as wel <br />as by the Division Director. A fine in the amount of $700 assessed and paid. <br />-6- <br />
