Section III
Status of Stipulations
The stipulation history for this site is difficult to follow due to the re-use of stipulation numbers
throughout the life of this site. Stipulations are a binding part of the permit and previously
assigned stipulation numbers are not to be re-used. However, it appears that procedure was not
followed in this case. Investigation of the stipulation response file, revisions to the permit, and
the findings documents indicate the following stipulations are still active, as shown below. It is
assumed that other stipulations issued over the life of this operation have been complied with or
terminated after review of various Files and documents maintained for this permit.
Both of the stipulations listed below were issued as a result of the Permit Renewal dated January
25, 1994. As indicated, both of these stipulations have been satisfied and are no longer active.
Stipulation Brief Description Status Comments
STIP NO. 52 HYDROLOGIC COMPLIED WITH
IMPACTS 3/7/94
STIP NO. 53 TOPSOIL & COMPLIED WITH SEE TR-37
REVEG 4/21/94
The active Stipulations to the permit at the time of this mid-term review, which originated from
previous permitting, are as follows:
Stipulation No. 2(461
IMMEDIATELY FOLLOWING STREAM CHANNEL RELOCATION
CONSTRUCTION AND BEFORE REROUTING THE PURGATOIItE BACK INTO
ITS PERMANENT BANKS, THE PERMITTEE MUST COMPLETE A SURVEY
OF THE NEWLY CONSTRUCTED CHANNEL.
