Section I -History <br />The New Elk Mine, previously known as the Allen Mine, has been in existence since 1951. The <br />mine operated under an interim permit issued by the Colorado Mined Land Reclamation Division <br />(now the Division of Minerals and Geology) on January 25, 1978 as required under the Colorado <br />Mined Land Reclamation Act. Colorado Fuel and Iron, (CF&I), the owners at that time, <br />submitted an application for a new permit on February 4, 1981, pursuant to section 34-33-109 of <br />the Colorado Surface Coal Mining and Reclamation Act. The application was reviewed by the <br />Division and a proposed decision was issued on December 19, 1983, permit !iC-81-012. <br />Transfer of permit rights has occurred twice since that time. Permit rights were transferred from <br />CF&I to Wyoming Fuel Company on January 31, 1984. Permit rights were transferred from <br />Wyoming Fuel Company to Basin Resources, Inc. on March 29, 1993. <br />Coal is no longer mined at the New Elk mine. However, the surface facilities remain and were <br />used to process and loadout coal which originated at the Golden Eagle mine (~lC-81-013) four <br />miles to the east. Mining at the Golden Eagle mine ceased on December 31, 1995. Remaining <br />coal stockpiles were trucked from Golden Eagle and processed at the New Elk facilities until <br />March of 1996, at which time New Elk requested and was granted Temporary Cessation (TC) <br />status.
