However, Grantee <br />shall consider Grantors reasonable comments concerning <br />the reclamation plan for Lye Property end Crantae shall <br />incorporate Grantor~^ comments into the reclamation plan <br />for the Property to the extant that such eommanb do not <br />materially increase the coat to Crantae, make thn <br />permitting !or L'~e mine and reclamation materially more <br />di!lieult or less likely to obtain, or create liability in <br />Grantee. <br />b. If the reclamation plan !or the Property <br />includes s pond as described herein and the reclamation <br />plan is not approved, in rho la or in part because o! ouch <br />pond, Grantee rill revise the reclamation plan !or the <br />Property. Grantor may review the'reviaed reclamation plan <br />!or the Property and provide comments to Grantee in the <br />came manner as provided in the immediately preceding <br />subsection. <br />c. Reclamation oL the Property shell commence <br />promptly alter the completion of the mining o! the send <br />and gravel lrom the Property or the thirtieth anniversary <br />of thin deed, rhiehaver occurs Lirst, and shall be <br />substantially completed within eighteen (18) months otter <br />the completion o! the mining o! the sand and gravel on the <br />Property or the thirtieth annivaraary o! this deed, <br />rhiehavar occurs first. <br />d. Grantee shall be responsible !or posting any <br />reclamation bond or other financial varrantiea or <br />undertakings required by the reclamation plan for the <br />Property or appropriate governmental authorities, except <br />rich respect Lo any bond or surety required for the water <br />rights for the pond described herein. <br />9. During the term of this conveyance the Sand and <br />Gravel Estate shall ba separately assessed far real property <br />tax purposes. Grantee shall pay the real property texas <br />assessed upon the Sand and Gravel Estate and Grantor shall pay <br />the real property taxes assessed upon the rameindar o! the <br />Property. <br />10.
