Except ae other~ise provided, Grantor, at its sole coat, shall furnish or cause to ba furnished to Crantaa avatar for the Grantees mining operations and, as apolicabla, thn voter substitute supply plan for the Property, and auq~entation and reclamation of t.'ie Property, in accordance with the following provisions. a. Grantor shall Lunish water rensonnbly uufficiant for the tutors sand and gravel aininq operations of the Grantee on thn Property, including avatar sufficient !or dust control. Grantor shel'_ be responsible for obtaining any voter rights or governmental approvals to use the avatar rights for these purposes. b. Subject to Saetion 8 hereof, Grantee shell ba responsible !or entarlnq into and obtaining gavarnmantsl approval o! a water substitute supply plan and/or augmentation plan necessary Lor reclamntion oL any of the Property that Sa mined by Grantee and that is not currently subject to a avatar substitute supply plan and/or augmentation agreement. If all of the appropriate regulatory authorities will permit reclamation o! a portion o! the Property as a pond, imperviously lined ar otherwise sealed to prevent groundwater infiltration into tlfa pond, Grantor shall reclaim a portion of the Property as such a pond. The size o! the pond surface shell be approximetnly, but shall mot exceed, fifteen (SS) acres. Grantee, in its sole discretion but subject to appropriate governmental approval, may create a pond with a surface in excess of lifteen (1S) acres. Grantor shall ba solely responsible for providing the water rights required for the pond, except thnt Grantee shall ba solely responsible for providing the excess water rights required !or the construction o! s pond with s surface in excess of liftssn (1S) scree. B. Grantee shall reclaim the Property aubetantially in accordance rith a reclamation plan spproved by the appropriate governmental authorities. lu used herein, the terse •raelamatian plane shall include the reclamation plan end any water substitute supply and augmentation plan required for the reclamation of the Property. Grantee shall design the reclamntion plan for the Property (and any revisions thereto) to ba proposed to the appropriate governmental authorities, im accordance with the provisions hereof. a.
