<br />Kye Abraham -2- <br />January 30, 1995 <br />I am concerned by your comment number 5 where you state that the BI.M was unaware you <br />are going to expand the lower waste dump. Your amendment application contains a signed <br />certified mail return receipt card addressed to the Department of the Interior in Montrose, <br />Colorado. Did you not send them a notice of your amendment application? If you didn't <br />you must send them, and any other land owner of record within 200 feet of the permit area, <br />a notice of your application. Normally, the applicant sends all owners of record within <br />200 feet of the permit area a copy of the publication. In your comment number 3 you <br />mention there is a private property owner along the route of the lower access road that is <br />encouraging construction of the mad realignment. If this person's property is within 200 feet <br />of the permit boundary you must send him a notice. To be in compliance with the Act and <br />the Rules you must send a notice to all land owners within 200 feet of the pemmt Boundary <br />and send proof to the Division that the owners were notified. <br />If you have any other changes to your permit, as a result of you stormwater management <br />plan, etc., you might want to incorporate them into the permit with this amendment because <br />the cost to amend your permit in the future will be considerable now that you are, or will be <br />shortly, a Designated Mining Operation. <br />If you have any questions, give me a call. <br />Sincerely, <br />~~ o~~ <br />James Dille <br />Environmental Protection Specialist <br />M:\OSSUmmUbnNm.jd <br />
