r <br /> <br />CONTRACT FOR REMOVAL OF GRAVEL <br />~~s~4~ ~ <br />This AGREEMENT is entered into between Andrew M. Castillo and Molly Castillo <br />(hereafter "Castillos") whose address is 25100 Count~Road 18.3. Valdez. Colorado 81082, <br />and Las Animas County located in the State of Colorado (hereafter "County") whose address <br />for the purpose of this contract is Las Animas County c/o Boazd of County Commissioners. <br />Las Animas County Courthouse 200 E. First Street. Trinidad. Colorado 81082. <br />1. Purpose. "Castillos" and "County" agree that "County" shall have the <br />right to enter the property accessing an existing road, described below in paragraph 3 and <br />hereafter referred to as the "Property" the right to ingress, egress, and regress to and from <br />the "Property", and this right shall extend to its agents, contractors, and employees, for the <br />purpose of excavating, crushing, removing and storing of all unprocessed and processed gravel <br />produced on the "Property" for the term of this agreement. The legal description of the <br />"Property" is as follows: <br />A tract of land located in part of the W 'fz of the SE Ik of Section 32, Township 33 <br />South, Range 65 West of the 6'" P. M., County of Las Animas, State of Colorado, <br />described as follows: <br />beginning at a point from which the center south 1/16 corner of Sec. 32, T33S, <br />R65W of the 6'" P.M., bears N 74d15'27° W 1200.23 feet <br />thence N 12-12-39 W 288.35 feet to a point <br />thence S 86-00-14 W 314.61 feet to a point <br />thence N 75-03-16 W 526.70 feet to a point <br />thence N 83-00-04 W 383.85 feet to a point <br />thence S 11-OS-22 W 436.82 feet to a point <br />thence S 54-39-23 E. 768.76 feet to a point <br />thence N 77-28-38 E 557.39 feet to a point <br />thence N 29-47-51 E 357.24 feet to the point of beginning <br />Containing 18.74 acres more or less. <br />l.a. "County" shall have exclusive right to excavate, crush, remove and <br />store all gravel, unprocessed and processed, and this right shall extend to <br />its agents, contractors, and employees. <br />l.b. "County" shall have an easement to enter the "Property" and remove <br />all unprocessed and processed gravel that is due to "County" that has <br />been stockpiled until stockpiles have been depleted for a reasonable time <br />after the conclusion of this agreement. <br />2. Compensation. In return for allowing "County" to come onto the <br />"Property" for the purpose of crushing and removing all gravel unprocessed and processed, <br />"County" will pay "Castillos" 35c (thirty-five cents) per ton of gravel removed. <br />Grovel Agreement between: Andrew M.
