This process actually started with TR-07, <br />decision date September 20, 1991, whereby the Division <br />approved adding a second six inch spillway pipe to the east <br />yard pond to bring it into compliance with the revised <br />regulation for combined spillways, Rule 4.05.6. At that time <br />Somerset and the Division both missed the requirement that the <br />crest elevation of the primary and emergency spillways must be <br />separated by one foot. Somerset is proposing to upgrade the <br />emergency spillway to a 12" CMP because it is the simplest way <br />to satisfy the Division's concerns. <br />3.
