r <br />Blue Ribbon Mid-Term - 3 - <br />Based on the above facts, the Division <br />rede iyn the crossing to safely handle <br />prec pitation event. After approval o <br />to be reconstructed and recertified by <br />construction season. <br />July 12, 1985 <br />requires Blue Ribbon Mine to <br />a 20 year - 24 hour <br />the design, the crossing is <br />the end of the 1985 <br />2. High stream flow in Hubbard Creek during the past two years has <br />overflowed the sediment pond/reservoir embankment on the north <br />end. This may be due to high flow, debris, channel realignment, <br />and/or embankment settling over time. In any case the breaching of <br />the dam disrupts the sediment collection function of the dam and <br />poses the potential f_or failure since the pond was not designed to <br />handle streamflow. <br />To protect the dam and sediment control functions, Blue Ribbon Mine <br />is directed to increase the embankment height. The height is to be <br />increased to provide at least one foot of freeboard over the 100 <br />year event or high water mark. The fill should be constructed in <br />accordance with rule 4.05.6 and recertified by the end of the 1985 <br />construction season. The source of the fill should be approved by <br />the Division in advance. <br />3. The application indicates that all facilities including ponds will <br />be retained until erosion control and revegetation is acceptable <br />(See Rule for details). Blue Ribbon Mine should amend the <br />reclamation schedule to provide for removal of the ponds when the <br />erosion control and revegetation requirements are met. <br />4. The reclamation and removal of the stream crossing (culvert) was <br />not specifically addressed. A plan for removing the stream <br />crossing should be addressed. <br />D. Operation Plan <br />Blue Ribbon Coal Company should submit current projections for <br />starting and termination dates for all remaining phases of mining <br />and reclamation operations. <br />E. Reclamation <br />1. Page 108 of the application states that the portals will be sealed <br />with non-combustible fill. Blue Ribbon Coal Company should <br />indicate the source of this material. The availability of fill <br />material may affect the bond amount. <br />2: Since the Blue Ribbon Mine is now experiencing significant mine <br />inflows, the applicant should discuss whether a discharge from the <br />portals is possible. If so, Blue Ribbon Coal Company should <br />include a portal seal design that will prevent discharge through <br />the portal and onto the bench. <br />
