<br />Blue Ribbon Mid-Term <br />-z- <br />July 12, 1985 <br />Decision to Require Revision <br />The Division ha conducted a mid-term review under Rules 2.08.3, 2.08.2(a), <br />2.06.3(4), 2.06 (3), 2.06.7(5), and 3.02.2(4). The review included the Blue <br />Ribbon Mine permit application, all subsequent revisions, all stipulation <br />responses, past inspection reports, and on site inspections. The Division <br />finds that certain revisions and modifications are needed to ensure future <br />compliance with the Colorado Surface Coal Mining Reclamation Act and the <br />Regulations of the Colorado Mined Land Reclamation Board for Coal Mining. The <br />following section details the revisions required, justification for requiring <br />the revisions, and timetable for submitting the revisions. Responses are to <br />be submitted as one package by August 30, 1985. <br />Part I. Revisions or Responses Required <br />Responses to the following concerns should be submitted in the form of a <br />technical revision by August 30, 1985, unless otherwise noted. <br />A. L~e a•1', Financial, Compliance and Related Information <br />C/ 1. The names of persons who collected technical data in the permit <br />application, dates of collection and analyses, and methods used <br />ing collection should be submitted. <br />The Resident Agent on page 6 should be updated. <br />B. Land Use <br />,/I. What coal seam was being mined at the old Blue Ribbon Mine? A map <br />showing the extent and location of surface disturbance associated <br />with the old Blue Ribbon Mine should be submitted. <br />C. Hydrologic Balance <br />1. The application indicates that the Hubbard Creek Culvert will pass <br />the 10 year - 24 hour storm event of 838 cfs but not the 20 year - <br />24 hour event of 1675 cfs. The culvert is sized for 1149 cfs, <br />~/~ therefore being 526 cfs underdesign. The haul road Rule <br />4.03.1(4)(e) requires that the crossing be designed for the 20 year <br />event. There is no variance provision in this subsection. Also, <br />in the past two years the culvert has been exceeded as a result of <br />at least three different precipitation events. <br />In at least one instance the failing of the culvert resulted in <br />stream flow being diverted towards and washing a portion of the <br />coal pile downstream. This would indicate that the underdesign of <br />the culvert is not as environmentally sound as the required 20 year <br />design standard. In addition, Blue Ribbon Mine has been producing <br />at a slower production rate, has recently rebuilt the mine bench, <br />and has been negotiating for additional coal reserves. All of this <br />indicates that the mine may be in existence longer than originally <br />indicated, thus making the likelihood of an additional failure more <br />probable. <br />
