C-83-038 <br />The following are concerns that were raised during by initial review of the <br />Colorado Westmoreland Orchard Valley Mine permit revision to construct the <br />Orchard Valley West Mine (OVWM) portal area. Since this is my initial review <br />additional comments may be forth coming. <br />Rule 2.03.10 Identification of Other Licenses and Permits <br />1. The right-of-way for the 46KV transmission line must be obtained from BLM <br />before construction of the OVWM site can begin. If CWI does not receive <br />the right-of-way before the Division's approval of the revision, a <br />stipulation will be attached to the approval requiring CWI to obtain a <br />right-of-way prior to construction. Also NPDES, air emissions and sewage <br />disposal permits must be submitted or a letter from the appropriate agency <br />authorizing a temporary variance. <br />Rule 2,04.4 Cultural Resource Information <br />Prior to the Divisions approval of the permit revision, the final reports for <br />the 2 archeology sites must be submitted and reviewed by the State Historic <br />Preservation Officer (SHPO) with the exception that if upon initial review of <br />the summary report SHPO does not have further concerns because the sites are <br />not significant the Division will only require that the final Report ~ ba <br />submitted later to be inserted into the final permit revision document. <br />Rule 2,04.7(1) Hydrologic Description, Ground Water <br />1. Have pump tests been run on the wells completed in the D seam close to the <br />proposed portal? If they have, what are the results? <br />2. Based on, the permeabilities of the D seam close to the proposed portal, <br />the contact area of the coal seam with the colluvium of East Roatcap Creek <br />and the location the area to be mined with respect to the colluvium how <br />much mine inflow will there be and how much water can be expected to be <br />removed from East Roatcap Creek as a result of these inflows? <br />423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel.
