Reduction of Subsidence Monitoring

The Division of Minerals and Geology hereby issues notice, in accordance with Title 34, Article 33, Section 116, Paragraph 4,
of the Colorado Revised Statutes, that on November 24, 2004, an application to revise coal mining operations at the Bowie
Mine No. 1 was considered complete for the purposes of filing. The revision was submitted by Bowie Resources, LLC. All
review and comment periods as provided in the Act and the Regulations initiate from this date of filing.
In Technical Revision No. 45 (TR-45), Bowie Resources LLC (BRL) is proposing a reduction m the subsidence monitoring
program at the Bowie No. 1 Mine. BRL is requesting that thirteen wide-spaced subsidence monitoring locations be eliminated
from the program. The subsidence montments are located on private surface land and on surface land managed by the Bureau
of Land Management (BLM). The coal reserves are managed by the BLM. The thirteen subsidence monuments are located in
the East Mine area, the Wes[ Mine area and the Stevens Gulch area. There has not been any mining at the Bowie No. 1 Mine
since December 1997. The mining method was room and pillaz with partial ext[action of the pillars during retreat mining.
The underground coal [Wining operation is on land located approximately 3 miles north of Paonia, Colorado. The permit area is
further described as follows:
Portions of Sections 1, 2, 10-I5, 22-25, Township 13 South, Range 92 West of the 6th P.M.
Portions of Sections 5-8, 17-19, 29 and 30, Township 13 South, Range 91 West of the 6th P.M.
The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle maps of Bowie and Gray Reservoir.
The applicant is required to publish notice in a local newspaper that this application has been deemed complete. At the time of
publication of this notice, the applicant is additionally required to place a copy of this application at the Paonia Public Librazy,
140 Grand Ave., Paonia, CO 81428, and at the Division office. For additional information or to provide written comments,
contact the Division of Minerals and Geology, Room 215, 1313 Sherman Street, Denver, Colorado 80203, [phone]. In
order for us to comply with regulatory time frames, we request that comments be submitted within fifteen (15) days of this
letter. If no comments are received by then, we will proceed on the assumption that you have no concerns with, or objecfions
to, the applicant's proposal.
