Monthly status update (continued from the October 1990 <br />Board Meeting). <br />The operator had been conducting reclamation at this site under a <br />settlement agreement developed in the spring of 1989. The site is <br />currently under alternative enforcement to accomplish reclamation. The <br />Board was reminded that, according to the bond release schedule of the <br />settlement agreement, the Division had published, on October 11 and <br />October 18, 1990, a decision to release 5437,696 of the operator's <br />5572,000 bond, leaving 5134,304. No requests for an adjudicatory <br />hearing had been received by the Division as of November 12, 1990, <br />which was the end of the public comment period. <br />The Office of Surface Mining (OSM) was present during the bond release <br />inspection in September of 1990. The Division received OSM's <br />inspection report on October 30, 1990. Staff explained that the <br />agreement the Division entered with the operator called for bond <br />release prior to the demonstrations required for bond release, but <br />would be followed by bond forfeiture. The settlement agreement was not <br />accepted by OSM. They objected to the bond release, because it was <br />more than 60% of the bond; about 77% was being released. Staff was <br />hopeful this outstanding issue with OSM could be resolved. <br />Although this is now a private operation, OSM stated a concern that <br />federal coal had been removed from the site in 1980 and 1981, and they <br />asked that the BLM conduct an investigation. The Division investigated <br />this issue with the BLM, and it is still not clear whether or not <br />federal coal was removed from the site during the period in question. <br />After the inspection, the BLM indicated they did not think federal coal <br />had been removed from the site. Their findings will be issued in about <br />3 weeks. <br />
