The Division has found that the application substantially meets the requirements of the <br />Colorado Land Reclamation Act for the Extraction of Construction Materials C.R.S. 34-32.5-10] et seq., and the <br />Colorado Mined Land Reclamation Board's (Board) Construction Materials Rules and Regulations. In accordance <br />with Rule 1.4.5(6), the Division is informing you that our recommendation is that the application be approved by the <br />Board, with the following conditions: <br />CONDITIONS FOR APPROVAL <br />I. Provide within 60 days of permit issuance the dimensions and location of the low unmined berm to be left on <br />the south and southeast margins of the pit. Provide the base width, top width and height and elevations for its entire <br />length. Include hydrologic calculations to demonstrate that the berm and pit floor will provide detainment fora !0- <br />year 24-hour storm event. Include specifications for installation of the discharge pipe including inlet and outlet <br />structures. Show the location of the berm and pipe on your mining plan map and reclamation plan map, if these <br />features will remain upon reclamation. <br />2. Provide within 60 days of permit issuance a document(s) that satisfactorily demonstrates to the Division that <br />Colorado City Metropolitan District (CCIviD) has transferred to the assets of Colorado City Development Company <br />(CCDC), including reclamation Permit No. M-1979-153. This document(s) will be used by the Division to show that <br />CCMD has transferred to Permit No NI-1979-153 and succeeds CCDC as the legal operator, in lieu of a properly <br />executed "transfer of Permit and Succession of Operators" form. <br />3. CCb1D will not affect any land by mining or reclamation activities within 200 feet of the San <br />Isabel Electric Powerline until it has complied with Construction btaterials Rule 6.4.19(a) or (b). <br />Because there remain objections to approval of the conversion application, the Division has scheduled aPre-Hearng <br />Conference and a Formal Public Heanne before the Board. The conference will be held at the Colorado Citv <br />Community Center, x705 Sante Fe, on July 17. 2000, beginning at 1:00 p.m. Catherine IGeager-Rovey has been <br />appointed by [he Board to be the Conference Officer. At the conference, Ms. lUaeeer-Rovey will propose a Draft <br />Pre-hearins Order including: <br />Party Names, addresses and phone numbers <br />2.
