<br />July 8, 1991 <br />Page 2 <br />Site 5RT118 is situated on the edge of the proposed <br />permit boundary on the opposite side of the <br />drainage in which a proposed haul road will exit <br />the minesite to the northwest. It is situated <br />outside proposed disturbance areas. However, it is <br />highly probable that blasting will be conducted <br />within 2,000 feet of the rock art panels. For <br />these reasons, Peabody proposed a plan to protect <br />and mitigate the site in letter correspondence <br />dated October 4, 1990 to the Colorado Historical <br />Society, Little Snake Resource Area Office of the <br />Bureau of Land Management, and the Office of <br />Surface Mining. Concurrence with the plan was <br />received from the SHPO on October 17, 1990. <br />This letter serves to inform you that work has been <br />completed at 5RT118. Enclosed please find an <br />original of updated pages of the site form, photos, <br />and a scaled drawing of the rock art panel at <br />SRT118. Peabody seeks concurrence that this <br />documentation is adequate to fulfill the <br />documentation requirements recommended in MAC's <br />1990 report of survey results in mine expansion <br />areas, the mine permit revision application, and to <br />which the SHPO concurred on October 17, 1990. <br />Following concurrence, Peabody will update the <br />permit revision application with all appropriate <br />documentation and correspondence. <br />This letter also serves to inform you that a <br />construction limits boundary has been posted around <br />the site to further prevent potential impacts to <br />portions of the site that might contain additional <br />data that could contribute to the site's <br />eligibility to the NRHP. All construction <br />activities, including vehicular and pedestrian <br />traffic, will remain outside the posted area. If <br />the boundary cannot be adhered to, Peabody will <br />notify the appropriate authorities, and an <br />appropriate plan for testing and mitigation will be <br />developed. <br />
