Frei, Walstrum <br />Mine, Clear Creek County - MLR Permit #83-33 <br />On behalf of our client Albert R. Frei we are submitting the <br />following answers to your December 24, 1984 and March 27, 1985 <br />adequacy letter questions. We will use the format presented in <br />the March 27, 1985 letter as our base. Please disregard the <br />amendments submitted prior to the attached amendment. This is the <br />final form that incorporates the changes made to satisfy the Clear <br />Creek County Commissioners resolution needed for their approval. <br />Exhibit D - Mining Plan <br />A. <br />1. This was denied by the commissioners and has been removed <br />from the plan. <br />2. Not applicable for this amendment. <br />3. Not applicable for this amendment. <br />4. The entire area will be filled. No 404 permit is needed <br />unless direct filling will be done in the water of the creek. <br />At this time the operator does not plan to fill in the creek, <br />if that becomes necessary a 404 permit will be applied for. <br />5. No. This area has been disturbed for many years. The area <br />has been part of a placer and milling operation since the <br />late 1800's and no soil was present to save. Growth medium <br />for the required reclamation will be taken from stockpiles <br />within the mine. <br />B. <br />1. The need arises in the placement of excess overburden. The <br />Commissioners expressed their wish to hide the operation from <br />i-70 west bound as much as possible. By filling this ravine <br />
