The FWS has been notified in writing that <br />SEM agrees to fund conservation measures in this total amount. <br />RECOMMENDATIONS <br />Bald Eartle <br />Due to the proximity of the SICM surface facilities and rail spur to bald <br />eagle winter habitat, we are concerned that the proposed activity may <br />minimally impact this endangered species. We therefore recommend that the <br />activity avoid all riparian trees in excess of 12 inches diameter at breast <br />height. A time of year restriction to minimize disturbance to the bald <br />eagle is not necessary, since a major construction along this rail spur is <br />proposed only during the summer months. <br />CONCLUSION <br />Should there be any changes in the amount of water depletion or any other <br />project change from that which was proposed which may affect any endangered <br />or threatened species, or if there is failure to agree to the Conservation <br />Measures outlined above, then the FWS should be contacted to determine if <br />further consultation is required. <br />bcc: SE, SLC <br />AFA/SE, Denver (Wathen) <br />BLM, GJ <br />Official file <br />Reading file <br />lU <br />
