This exhibit <br />is, however, expected to include an estimate of the water <br />requirements for the project and the sources of that water, <br />information which it does not have. There is also no <br />statement in this exhibit regarding aquisition of or <br />application fora NPDES permit from the Colorado Water Quality <br />Control Division. Exhibit M narrative appears to indicate that <br />inquiry was made in regard to the need for a number of <br />permits, possibly including a NPDES permit, and many are not <br />required. The fact that this applies to a NPDES permit, <br />however, needs to be specifically confirmed for the Division. <br />A r~wised E:;liibit G should be provided which includes the <br />information requested above. <br />EXHIBIT N: The Division will accept the statement that the <br />o~ County owns the land on which the Airport Gravel Pit is <br />located if an accurate legal description of the land owned is <br />made in Exhibit A. <br />EXHIBIT O: Exhibit C, as indicated earlier in this review, <br />does not clearly establish the County's ownership of the <br />surface of the land to be affected by the mining and of the <br />substance to be mined. If the Division's questions in regard <br />d;t to Exhibit C can be resolved, the Division will accept the <br />statement made under Exhibit 0. <br />EXHIBIT Q: The Divison will accept that the required notice of <br />the conversion application was hand delivered to the Las <br />Animas County Commissioners. It is less certain that the ,~~ <br />notice hand delivered to the local Soil Conservation Service <br />office, will, as actually required, reach the Board of <br />v Supervisors of the local Soil Conservation District. <br />D' <br />Please provide evidence that the "notice" of the application <br />required to be sent to the Soil Conservation District was, in <br />fact, received by the District. <br />EXHIBIT S: The statement made under this exhibit is noto1~, <br />entirely accurate, unless the NS trending fence in the western <br />part of the proposed permit area is not to be considered <br />permanent. <br />A revised Exhibit S should be provided that confirms the <br />by existence of this fence, its ownership and what is intended to <br />happen to it, ie. it should be made clear that the County owns <br />the fence (if it does) and can and will remove all or parts of <br />
