BEI wishes to further clarify Point (3). It believes (along with BMG) that this
point refers to the suitable reduction of free-cyanide (as defined in Appendix
I) and not to the reduction of Cu WAD.
However, BMG is (like the State} sufficiently concerned about Cu WAD that 1t
wishes to discuss its elimination aTSO, herein.
A. Timetable for Free CN Reduction
Conditions
1. The Cytox chemical shall be used to reduce (CN)~ to acceptable levels of
less than 30 ppm. '(t.~ ~~,,,_ ,,,~~,~„~, ,~
2. The ponds contains 301 x 108 gal. of water which is recycled at
approximately V DOD gal ml and therefore requires 21 days to
"theoretically" have complete pond replacement.
3. BEI requests that Colorado permit two pond cycles t0 achieve safe levels
of free-cyanide: say 42 days.
4. BMG shall, for 42 days, provide "defense" to prevent the landing of
wildfowl and thereby forestall even the possibility of their death.

Oyr modus operandi shalt be as follows: J
1. BEI shall install a fait-safe "Cytox Delivery System" at BMG San Luis
accurate to ±0.7 1b/min and delivering at approximately 2 1b/min depending
upon stoichiometry. ~(.~,

3. Said system to be installed prior to the existing AVR.
4. Said system to reduce pH (depending upon stoichiometry) to between ph 8.5-
