D. DMG's Finding~Regardi~ Backfilling_& Grading;
1. [Reference Exhibit 6 (Letter from CO Div, of
Wildlife)]
Terraces complement postmining land use of
wildlife habitat
2. Width and spacing of terraces is appropriate for
erosion control and water retention for pasture
3. [Reference Exhibit 7 (Slope Stability Analysis)]
The outslopes have a static safety factor of 1.48
E. Rule 4.03.1(1)(fj requires haul roads to be reclaimed unless the
DMG approves retention as compatible with land use and the
landowner requests it.
F. DMG's Findings Re arding Retention of Haul Roads:
1. Roads are compatible with pasture use
2. The owner has requested partial retention of haul
roads
3. The DMG approved partial retention of haul
roads in TR-7 which was approved in 1991
SUMMARY
The Division finds that the retention of terrace outslopes and portions of the haul road aze
appropriate for the proposed postmining land uses of pastureland, cropland and wildlife
habitat. The Division therefore requests that the Board uphold the proposed decision to
approve TR-10.
LIST OF EXHIBITS
Exhibit 1 - Request for formal hearing
Exhibit 2 - Citizen's Complaint re: availability of records
Exhibit 3 - Figure 4.7-3 (pg. 1) from TR-10 showing additional length of
haul road proposed to be retained
Exhibit 4 - Figure 4.7-3 (pg. 2) showing original and proposed x-sections
Exhibit 5 - Slides showing terraces and terrace outslopes of the mine site
Exhibit 6 - .Letter from Colorado Division of Wildlife
Exhibit 7 - Exhibit 4.7-5 from TR-10 (Engineer's report addressing stability
concerns for the terrace outslopes)
Exhibit 8 -Proposed changes to the Post Mining Land Use
3
