Boulay, <br />Pursuant to Rule 3.03.1, Seneca Coal Company (SCC) submitted a formal Phase I Bond Release Application (on May <br />22, 2006) for 2,247.7 acres of lands where successful completion of backfilling, regrading and drainage control has <br />occurred. This application has been prepazed and is submitted in accordance with the Cohmdo Divirion ofMineralr and <br />Geology (DMG) Guideline Regarding Selected Coal Mine Bond Rekare Issuer (April 18,1995), Ruk 3.03 Rekare of Performance <br />Bondr. <br />Copies of the letters sent to surface owners within and adjacent to the permit boundary, holders of easements on the <br />property, and local government bodies providing written notice to seek release were included in the application package <br />in Attachment B. <br />The "Public Notice" was sent to the Steamboat Pilot for four (4) continuous publications. The first publication <br />occurred on May 21, 2006 and the last publication occurred on June 11, 2006.
