Such mitigation may include, but is not limited to, revegetation, dust <br />control, noise control, visual screening, limitations on bouts of operations, truck haul routes and <br />traffic volumes, <br />5-I6Q3 Enforcement of State and Federal Regulations <br />In the event that the County discovers that applicable state and/or federal regulations pertaining <br />to a specific mining activity in San Miguel County have not bees adequately enfoiced by the <br />appropriate agency or organization, the Board of County Conunissioners tnay require the muting <br />activity to comply with any and all rectos of such regulations. If such regulations are not <br />complied with, the Board of County Commissionns may order such mining activity to cease and <br />desist. <br />5-1604 Trafllc Impacts and Highway Access <br />Mining (including sand and gravel operations) and mineral processing shall be limited to the <br />greatest extent possible to azeas where the surrounding road, street and/or highway nehvoric can <br />accommodate heavy truck traffic. In no event shall a proposed operation be permitted where the <br />carrying capacity of the surrounding road, street and/or highway network is exceeded by existing <br />traffic volumes, or would be exceeded by projected or proposed traffic volumes. <br />3-l b05 Additional Notice Requirements <br />In addition to the notice requirements set forth in Section 3-9, applicants for approval of mining <br />and mineral processing operations shalt also be required to provide written notice of a pending <br />application by mailing such notice first class, postage pzepaid, no Less than ] 20days prior to the <br />scheduied meeting date to all owners of property within 1,300 feet of the subject property, and to <br />all municipalities withiot 3 miles of the subject property. <br />.'~herlyl_n~q~l.~nliratinn C'.onatderaHnn <br />Once the 1'lanrtutg Deparnnent has received sEx copies of a comple[e application that confomas <br />to all applicable Land Use Code requirements, the Planning Department can schedule the <br />application for consideration, The Planning Department may refer the application for comment <br />and recommendation to tb,e County Attorney, County ]'snvironntental Health Specialist, the Town <br />of Ophir, the Colorado Departrneat of Transportation and the Colorado Division of Minerals and <br />Geology.
