• <br />section 2.2 Identification of Interest <br />2) The Identification of Interest Section of the germit, <br />Section 2.2, lists the owners and controllers of NCIG. <br />The pages date back to 1991. Please update the list of <br />officers and directors or indicate if no update is <br />needed. <br />3) Section 2.2.2 of the permit lists the Owners of Record. <br />if any of the surface owners, owners of coal, or lease <br />holders have changed since 1991, please update the permit <br />pages. <br />section 2.3 Compliance Information <br />4) Rule 2.03.5(3) requires that a list of violation notices <br />received by the applicant be included in the permit <br />pages. The last violation in the permit pages dates back <br />to August 4, 1989. Please update the list of violation <br />notices in Section 2.3.2 of the permit application. <br />section 2.6.2 Anticipated Starting Date of Operation <br />5) This section needs to be updated to reflect the current <br />status of the operation. <br />Section 2.8 Identification of Other Licenses and Permits <br />6) Please. revise Section 2.8.1 to show that the Garfield <br />County Special Use Permit has expired. <br />7) Please update this section for any other permits which <br />may have expired or are no longer applicable. <br />Section 3.1.3 Previous Nininq <br />8) Page 3-7 lists steps to be taken during project <br />development to deal with previous mining disturbances. <br />NCIG should submit to the Division a copy of the Garfield <br />County Special Use Permit and clarify whether the <br />requirement of these tasks is contingent upon project <br />development actually taking place. If so, NCIG should <br />commit to completing these tasks during reclamation. If <br />not, NCIG should revise the text accordingly. <br />9) Page 3-8: NCIG should update the description of the <br />postmining land use if any changes are intended. If <br />changes involve loss of wildlife habitat, NCIG should <br />contact the Colorado Division of Wildlife for approval. <br />5 <br />
