The water rights that <br />I 13 are associated with the Columbian Ranch are <br /> 14 currently adjudicated for irrigation use only. <br /> 15 So that what Battle Mountain needs to do <br /> 16 is essentially a two-step process -- to make these <br /> 17 water rights useable within the project. In a <br /> 18 change of use proceeding, which is part of the <br /> 19 augmentation plan, the main criterion that is looked <br /> 20 at is, what was the historic consumptive use of the <br /> 21 water rights, so that if the court grants a change <br /> 22 of use for those water ri <br />hts <br />onl <br />that amount of <br /> g <br />, <br />y <br /> <br />~ 23 water that's been historically depleted from the <br />_ 2a stream is available for transference. <br /> 25 So the process that we went through was <br /> AGREN, BLANDO & BILLINGS <br /> <br />
