File No. M-1989-029 r,/ r/ <br />Longmont Distel Operations 112(c) Technical Revision Application (TR-04) Second Adequacy Review <br />Deaz Mc Hart, <br />Listed below are the second adequacy review comments for the Longmont Distel Operations 112(c) Technical Revision <br />Application (TR-04), File No. M-1989-029. The Division of Minerals and Geology ("Division") is required to make a <br />decision no later than November 8, 2004, therefore, your response to the following adequacy review concerns should <br />be submitted to the Division as soon as possible. <br />Related to the response to Concern #I from the first adequacy review, the response stated that "the six (6) acre <br />permit azea reduction is based on deleting 9.6 acres from the current permit area north of the St Vrain River and <br />adding 3.7 acres of a previously permitted pazcel (DMG) Permit #M-1979-113) known as the Boulder Creek <br />Estates Pit which, like the release azea, is owned by the City of Longmont" Please be aware that the following <br />procedures will need to be completed in order to release the 9.6 acres from the current permit without processing <br />the request as a sepazate Acreage Release request: <br />• A map identifying the location(s) of the specific 9.6 acres to be omitted must be submitted to the Division <br />for review. <br />• The Division must conduct an inspection of the 9.6 acres in order to determine that the acreage has not <br />been affected by the mining activity at the site, Prior to that inspection, the boundaries of the acreage to be <br />released must be marked at the site. <br />• A map depicting the new permit boundary -excluding the 9.6 acres to be released -must be submitted to <br />the Division as a record of the new permit azea. <br />The Division is aware that the maps submitted with the Technical Revision request may fulfill the last of these <br />requirements, but a statement from the Applicant confirming this is necessary for Division records. <br />With regazd to the inclusion of the 3.7 acres, the following procedures must be completed in order to add this <br />acreage: <br />• A map identifying the location(s) of the specific 3.7 acres to be added must be submitted to the Division <br />for review. <br />• The Division must conduct an inspection of the 3.7 acres in order to determine that the acreage has not <br />been affected by the mining activity at the site.
