• Provide an appropriate engineering evaluation that demonstrates that such structure shall not be <br />damaged by activities occurring at the mining operation; or <br />• Where such structure is a utility, the applicant may supply a notarized letter, on utility letterhead, <br />from the owner(s) of the utility that the mining and reclamation activities will have "no negative <br />effect" on their utility. <br />6. Exhibit C reflects that the access road will be mined through and relocated as a result of the mining <br />operation. Please locate the approximate azea of the new road to be constructed in its place and <br />specify the dimensions of the new road that will be used for the mining operation. Any <br />improvements necessary on existing roads or new roads must contain specifications used in the <br />construction (length, width, road material, etc...). In addifion, the owners of the road will need to <br />submit a notarized letter allowing for the removal and reconstruction of the access road as a result of <br />the mining operation. <br />7. The Alta Survey Map included in the application includes a feature noted as a 4-foot by 7-foot <br />dynamite shed. Please state if explosives aze to be used during this mining operation. If so, please <br />demonstrate through appropriate blasting, vibration, geotechnical and structure engineering analyses <br />that off-site azeas will not be adversely affected by blasting. <br />Rule 6.4.5 Exhibit E-Reclamation Plan <br />8. The applicant states that topsoil piles will be seeded with an appropriate cover crop to prevent <br />erosion. The applicant will need to specify a temporary seed mixture, fiming of such seeding, the <br />seed rate and application method. <br />9. The applicant states that soil amendments shall be applied where soil tests indicate nutrient <br />deficiencies for the plant species to be established. Please further explain the soil testing that will be <br />conducted on site. <br />10. Please describe the methods of weed control that will be employed for all noxious weed species on <br />site. The applicant will need to include a mitigation plan to control all noxious weeds and plan of <br />implementafion in the event a weed problem exists. <br />Rule 6.4.7 Exhibit G- Water Information <br />11. Please state the depth to groundwater in the azea to be mined. In order to not affect the groundwater <br />system,_the orator will need to commit to sta~in~two feet above the seasonal h~ water elevation <br />at all times during mining and reclamation of the site. <br />12. As noted in the letter from the Office of the State Engineer (OSE) dated November 15, 2004, the <br />applicant has not identified any proposed use of water at the permit site. If water will be used for any <br />purpose at this site, the applicant will need to document the water was obtained from a legal source, <br />or the water was diverted in priority under a water right decreed for such industrial use. Please see <br />attached letter for clarification. <br />13. As also noted by the OSE, if stormwater runoff is intercepted by this operation and is not diverted or <br />captured in priority, it must be released to the stream system within 72 hours. This may require a <br />discharge permit from CDPHE-WQCD. Otherwise, the operator will need to make replacements for <br />evaporation. <br />Rule 6.A.13 Exhibit M- Other Permits & Licenses <br />14. Please be aware that Larimer County provided a letter to the Division dated November 23, 2004 that <br />requires a Special Review approval from Larimer County to change forma 110(c) to a 112(c) permit. <br />The letter is attached for your review. <br />
