Cattany <br />Division Director <br />Natural Resource Trustee <br />Listed below are adequacy review comments on the Russell Gravel Pit Conversion Application (CN-Ol), <br />Permit No. M-1994-096. The Division of Minerals and Geology (Division) is required to make an <br />approval or denial decision no later than February 7, 2005, therefore, your response to the following <br />adequacy review concerns should be submitted to the Division as soon as possible. <br />1. Please submit the proof of notice to all owners of record of surface lands, mineral owners, easement <br />holders, and owners of record of surface lands that aze within 200 feet of the boundary of the affected <br />land. Proof of notice may be retlun receipts of a Certified Mailing or by proof of personal service. <br />Rule 6.4.3 Exhibit C- Pre-minine and Mining Plan Maps <br />2. A number of mining related features aze located outside of the permit boundary area. Such features <br />include the proposed topsoil and fill dirt stockpile area, scale house, scale, trailer, diesel fuel tanks <br />and pile adjacent to the entrance road. Al] mining related structures must be located inside the permit <br />boundary area. Please revise the maps accordingly. <br />3. Rule 3.1.9 states that topsoil shall be removed and segregated from other soil. The [opsoiUfill pile <br />noted on Exhib$ C-appears fD bea combination of both~rraterials. Please revise the mining plzari and <br />map to depict a separate pile for topsoil and fill overburden. <br />4. Fuel tanks are depicted on Exhibit C. Please inform the Division how the tanks will be lined or <br />bermed in the event of a spill or leak. <br />Rule 6.4.4 Exhibit D- Mining_Plan <br />5. The applicant will need to indicate how close the mining operation will be to structures located on the <br />site. In particulaz, the frontage road is within 200 feet of the affected azea. The applicant will need to <br />specifically state how close the pit excavation, roads and topsoil piles will be to permanent man made <br />structures such as homes, roads (including the frontage road), wells, utility lines, etc... Please be <br />awaze that if mining is to occur within 200 feet of any permanent man made structure, the applicant is <br />required to either; <br />Provide a notarized agreement between the applicant and the owner of the structure that the <br />applicant is to provide compensation for any damage to the structure; ar <br />Office of Office of Colorado <br />Mined Land Reclamation Active and Inactive Mines Geological Survey <br />
