<br />Technical Revision -Exhibit M <br />Other Petmits & Licenses <br />Other Permits and Licenses <br />Cotter realized that other agencies besides DMG have regulations covering surface activities <br />related to underground mining, as listed below. <br />1) The azea ofthe Wright Mine is zoned "agriculture" by Montrose County, and as such, <br />mining and subsequent expansion to existing operations is a "use-by-right". <br />2) The Montrose County Engineer has been informed of Cotter's intention to be crossing <br />county road U-17 with mining equipment. A site specific access permit concerning <br />traffic control, signs, etc. will be issued by that office (see attached letter) <br />3) The mineral lease between U.S. Department of Energy and Cotter Corporation <br />requires Cotter to notify and receive approval from DOE of any modifications to <br />Cotter's mining plan. This will include obtaining DOE approval for the proposed <br />ventilation hole site. <br />4) The Bureau of Land Management will be notified of Cotter's intent since BLM is <br />manager of the adjacent land. <br />5) Cotter will modify it's Stormwater Discharge Permit, as needed. <br />6) Cotter will comply with all MSHA applicable regulations. <br />• 7) Cotter will comply with all state and federal transportation regulations applicable to <br />ore shipments. <br />• <br />SM-18 Application for Technical Revision -Page 13 - 7/14/2004 <br />
