Cattany <br />Acing Division Director <br />This Office has begun the PAR for the above referenced amendment (AM-01) to change <br />the post mine land use to conform to the landowners (Eagle County) future and current <br />use. Currently the approved plan calls for the land to be reclaimed to agricultural use. <br />Eagle County through its "Recreation Master Plans" worked with LaFarge West to reclaim <br />the Area "A" Phase to conform to this plan. Additional areas within the mining permit fall <br />under this Master Plan. The requested amendment to the application is a technicality that <br />must be addressed in order for the Division of Minerals and Geology (DMG) to consider <br />any future reduction of the Financial Warranty or release of reclaimed lands under the DMG <br />approved plan. Please clarify or address the following issues pertaining to this PAR: <br />1) Exhibit "C", "F" and. S-1. The supplied map(s) does Ido) not have the required <br />signature of the qualified person who prepared it (them) as required by Rule <br />6.2.1(2)Ib). Please supply one original and two copies of a corrected versionls) of <br />the map(s) with signature and any other issues noted in the application review <br />process. <br />21 Exhibit "C" does not meet the requirements of Rule 6.4.3. Please submit corrected <br />maps with the required information. <br />3) Maps do not define Phase boundaries. Where is the exact boundary between Phase <br />"A" and "B"? Please note on maps. Does Area "A" include ball fields and <br />associated acreage? How many total acres are in Area "A"? <br />4) Exhibit "D" the Mining Plan references topsoil and overburden stockpiles to be <br />placed at the top of the slope on the northern edge of Area "D". CRS 34-32.5-116 <br />(4)(g) requires that topsoil /overburden be protected from wind and water erosion if <br />left in place for more than 12 months. Please address this issue within the Mining <br />Plan. <br />
