5. The Lessee shall not assign this Lease nor sublet the property, or any part thereof, without the <br />prior written consent of Owner thereto. No assignment, pledge, or mortgage of this Lessee's <br />interest herein shall be made without the prior written consent of Owner thereto. <br />6. All notices and demands herein required shall be in writing. The mailing of a notice by <br />registered mail to Owner at: <br />The Augustine 7. & Margaret DeHerrera Family Trust <br />P.O. Box 123 <br />Tres Piedras, NM 87577 <br />Or to the Lessee at <br />Conejos County Commissioners <br />P.O. Box 157 <br />Conejos, CO 81129 <br />Shall be a sufficient service thereof. <br />8. If more than one joins in the execution hereof as Owner or Lessee, or either be of the <br />feminine sex or corporation, the pronouns and relative words used herein shall be read <br />as if written in plwal, feminine, or neuter, respectively. <br />V. OPTION TO BUY AND SELL REAL ESTATE <br />The owner (hereinafter sometimes referred to as seller) hereby gives and grants to The Lessee <br />(hereinafter sometimes referred to as buyer) the option to pwchase all of the described property <br />for the sum of $232,737.96. The Lessee by giving written notice of intention to exercise the <br />option within 60 days thereof may exercise such option at any time subsequent to the ninth year <br />of the rental term of this agreement or eazlier upon mutual agreement of the parties. <br />The pwchase price to be paid by buyer to seller for the property shall be the sum of $232,737.96. <br />All rental payments will be credited toward the purchase price. <br />Said purchase price is payable by buyer to seller as follows: with cash or certified funds on the <br />balance. <br />Possession of said property shall be on the date of closing. In the event of delivery of possession <br />prior to closing, it is expressly understood and agreed that buyer shall not, and does not, have the <br />power or authority to incw any liens against the property. Nor does buyer have the right to make <br />improvements to the property or premises prior to the closing of this contract, except as herein <br />set forth or later permitted. Public notice is hereby given of such lack of power; provided, <br />however, that the buyer and his agent(s) shall be, and are hereby, allowed to enter the property <br />for those purposes as may be agreed upon between the parties. The owner will within 15 days of <br />the execution of this agreement provide a title insurance policy on the subject property. <br />
