3. All the necessary implements, machines, equipment, and tools for the operation of the <br />property. <br />4. The Lessee agrees that they shall be responsible for the payment of all services delivered to <br />the Leased Premises on behalf of the Lessee. <br />5. The Lessee agrees peaceably to deliver up possession of the property at the end of the term or <br />upon sooner termination in good order and condition. Ordinary wear, depreciation, and loss <br />or damage to the improvements by fire or by the elements excepted, unless there is exercise <br />of the option of purchase herein contained. <br />SECTION D. TERNIINATION <br />Rights Prior to Tennination_ The Owner reserves the right to enter upon the property for the <br />purpose of viewing the same. <br />Owner Termination. The Owner shall have the right to termination ofthis lease for nonpayment <br />of the rent, taxes, or other substantial on continuing violation of the terms of this lease. <br />Lessee Termination. The Lessee shall have the right of termination of this lease, exercisable by <br />written notice of intent to do so, filed no later than 60 days prior the next ensuing yearly term of <br />lease. <br />SECTION E. GENERAL COVENANTS <br />1. No work, supplies, or materials shall be charged to Owner or contracted for in the name of <br />Owner by the Lessee without prior written authority to do so. <br />2. The Lessee agrees to take possession of the premises and gravel pit subject to the usual <br />hazards attendant to the operation of the property and agree to assume all risks and liability <br />for accidents to themselves, employees, servants, guests, and agents in the pursuance of the <br />gravel extraction operations or in performing repairs to the gravel pit. <br />The Owner shall not be liable for, and The Lessee hereby waives, renounces, and releases all <br />claims, demands, and causes of action for damages to person or property of every kind and <br />character, sustained or suffered by The Lessee or those claiming by, through, or under him, <br />and The Lessee shall forever protect, indemnify, and save harmless Owner of and from all <br />claims, loss, and damage (including attorneys fees) it may suffer arising from the operation <br />of the property. <br />4. Each party shall reimburse the other prevailing party for costs, attorney's fees, and expenses <br />that shall be paid or incurred by it in the enforcement of this Lease. <br />
