I believe that you have received a letter from the WAPA District Office clarifying that they <br />were not objecting to our application, merely providing comments and wanting to clarify the <br />responsibilities: <br />1) WAPA will continue to have access to their power line towers throughout the <br />mining and reclamation period, via ramps and roads, as well as after reclamation. <br />Presently, WAPA gains access through the existing County Pit and this route will <br />generally remain open. <br />2) There will be no stockpiles underneath the power lines, and equipment operators <br />will be trained before working within 500 feet of the power lines, regardless of the <br />equipment being operated. <br />3) There will be no disturbance by mining within 200 feet of the towers. Other than <br />casual use of roads/trails for inspections, and such necessary emergency actions as <br />fighting weeds and fires, we do not expect to go near the towers. The set-back will <br />marked in some appropriate way to notify operators. <br />4) We will coordinate with WAPA's maintenance office at Shiprock as activities <br />around the power lines take place, so that both our operations and theirs will be <br />inconvenienced as little as possible. <br />2. Map scales: all map scales in the application are in feet. My apologies for any <br />confusion. <br />3. Fence lines: a copy of the lease agreement, which contains a compensation agreement <br />for property which might be damaged, is attached. Spec~cally, Condition #4 on page 2 of the <br />basic agreement states "Haycamp hereby agrees to construct, repair and install any necessary <br />cattle guards, gates or fences which may be required..." and Condition #8 on page 3 states "At <br />the owners' discretion, portions of reclaimed areas may be left or designated as pond areas or <br />other appropriate sites." By "pond areas" is meant areas where water can collect and infiltrate <br />into the ground. The agreement also requires obtaining and complying with DMG permit. (Four <br />States Aggregates LLC is the successor to Haycamp Sand and Gravel.) <br />
