The Division does not believe that leaving a road 25-feet wide is compatible with the proposed post <br />mining ]and use. The operator has the following options; <br />o As an alternative to leaving the haul roads in their current configuration, the operator may opt to <br />reduce the width of the haul roads to be more compatible with the end land use, or <br />o provide documentation from Larimer County stating that a 25-foot wide road conforms to their <br />local building and zoning codes. Such documentation must be a letter from Larimer County <br />stating that the road left in place will meet the zoning requirements and the approved post-mining <br />land use. <br />Please be advised that the Wagner/Kauffman Pit #3 application may be deemed inadequate, and the <br />application may be denied on December 26, 2005 unless the above mentioned adequacy review items aze <br />addressed to the satisfaction of the Division. If you feel more time is needed to complete your reply, the <br />Division can grant an extettsion to the decision date. This will be done upon receipt of a written waiver of <br />your right to a decision by December 26, 2005 and request for additional time.
