Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division received yoltr adequacy responses on December 16, 2005 regarding the Wagner/Kauffman <br />Pit #3 Amendment O1 Application (AM-O1), Permit Number M-1999-069. The Division has a few <br />additional comments that need to be addressed prior to approval of the application. The Division of <br />Minerals and Geology ("Division") is required to make an approval or denial decision no later than <br />December 26, 2005, therefore, your response to the following adequacy review concerns should be <br />submitted to the Division as soon as possible. <br />The operator proposes to use the seed mixture proposed in the amendment application rather than the <br />seed mix approved in TR-Ol (approved on Apri129, 2003) for Phase I. Upon further review of the <br />seed mixture approved under TR-O1, the seed mix was requested by the landowner, Flying W Ranch <br />Loveland, LLC, and recommended by the Natural Resource Conservation Service (NRCS) for the <br />upland pasture azea of Phase I. The seed mix recommended by the NRCS consists of all native <br />species (see attached TR-Ol application). The seed mixture proposed by the applicant in this <br />amendment application consists of the following species; <br />UDiand Grass Seed <br />Crested Wheatgrass, Hycrest <br />Russian Wildrye, Swift <br />Smooth Brome, Lincoln <br />Perennial Ryegrass, Telraploid <br />Orchazdgrass, Renegade <br />Intermediate Wheatgrass, Oahe <br />Area Cover (%) #PLS/acre <br />20 3.0 <br />20 3.0 <br />20 3.0 <br />1 S 2.25 <br />1 S 2.25 <br />10 1.5 <br />These species proposed by the operator all are introduced, and in particular Crested Wheatgrass is a <br />very aggressive specie that may dominate the other grass species over time. The Division <br />recommends that the mixture proposed in the AM-Ol application take some of the native species <br />approved in TR-O1, and remove some of the aggressive introduced species. <br />2. The operator proposes to leave an existing 25-foot road to remain as a component of the reclamation <br />plan. Section 34-32.5-116(4)(a) of the Colorado Land Reclamation Act for the Extraction of <br />Construction Material states that grading shall be tamed on so to create a final topography <br />appropriate to the final post-extraction land use selected (pastureland and developed water resources). <br />Office of Office of Colorado <br />Mined Land Reclamation Active and Inactive Mines Geological Survey <br />
