Linadn County <br />Permit Application No. 04LI7172F Colorado Department of Put>fic Health and Environment <br />APEN RequiredlPemut Exempt Air PaUution Control Division <br />A Revised Air Pollutant Emission Notice (APEN) shall be filed: (Reference: Regulation No. 3, Part A, <br />Section II.C.) <br />s. Annually whenever a significant increase in emissions occurs as fallouts: <br />For any criteria pollutarrt: <br />For sources emitting kss than 100 tons per year, a change in actual emissions of five <br />tons per year or more, above the level reported on the last APEN submitted; or <br />b. Whenever there is a change in the owr-er or operator of any faality,process, or activigr; <br />or <br />c. Whenever new control equipment is installed, or whenever a different type of control <br />equipment replaces an existing type of contro! equipment; or <br />d. Whenever a permit limitation must be modified; or <br />e. No later than 30 days before the e>isting APEN expires. The five-year term for this APEN <br />expires on 09102/08. <br />Any changes with reseed to the original submittal that would reauft in an irxxease in production above <br />70,000 tons per year automatically nullifies this exemption. t9efore actually making any such change, you <br />must apply to the Division for a udion permit based on the antiapated change. A permit must be <br />obtained tBEFORE implementing the change. <br />This exemption is for mining related activities only.
