The Division determined no emission permit is required forthe above referenced <br />sauce since surface mining a~vkies that mine 70,000 tons per year or less are specifically listed as being <br />exemptfrom permitting requirements (Reference: Regulation No. 3, Part B, Secdort II.D.1.g.). However, an <br />Air Pollutant Emission Notice (APEN) is required since uncontrolled emissions of particulate matter will be <br />more than 2 tons peryear (Reference: Regulation No. 3. Part A, Sediort II.B.3.a). <br />This exemption from permR requirements is issued in reliance upon the acwreCy and completeness of <br />information supplied by the applicant and is conditioned upon construction, installation, and operation in <br />acx;ordanoe with this information and with representations made by the applicant or the applicants agents. <br />Specifically, this exemption furs been granted provided that the following information is accurate and <br />complete: <br />1. The production rate does not exceed 70,000 tons per year. Annual records of the acxual production <br />rate shall be maintained and made available to the Division for inspection upon request. <br />2. The applicant shall follow the fugitive dust control plan ae submitted witlt the application. <br />The following actual controlled emissions of total suspended partiwlstes (TSP) and particulate matter of <br />less than ten microns (PM,o) are estimated based on the production rates listed on the APEN. This <br />information is listed to inform the operator of the Division's analysis of the TSP and PM,o emissions.
