:~ <br />' -3- <br />6. The parties agree to try and resolve conflicts at the operating <br />manager level. Rny unresolved conflicts will be reported to the State <br />Director, BLM and to the Director of the Colorado Department of Natural <br />Resources for further consideration. , <br />V. Insoection <br />1. The Board will be the point of contact in dealing with the <br />operator concerning operations and compliance with the requirements covered by <br />this Memorandum. <br />2. The BLM will periodically monitor operations for compliance with <br />permit conditions and other Federal Requirements. Any evidence of <br />noncompliance with the permit and State law or regulation will be forwarded to <br />the CMLRB for necessary action. <br />3. Final inspections of operations will be preceded by notice, from <br />- - either party of intent to inspect. Final inspections will be jointly <br />conducted to the extent permitted by agency schedules and personnel <br />availability. Any inspection reports will be exchanged to facilitate review <br />- of the operation. <br />---- VI. Enforcement <br />1. Enforcement actions by CMLRB will satisfy BLM obligations under <br />--- - 43 CFR 3809.3-2. BLM retains authority to undertake any enforcement action <br />against operations involving NHPA, Endangered Species Act, and NEPA, as well <br />as those operations where it has sole jurisdiction (i.e. access routes that <br />lie outside of CMLRB permit boundaries). <br />2. The ac4ninistering agencies will promptly notify each other of <br />all violations of applicable laws, regulations, orders, approved pernits, <br />plans, licenses, or notices subject to this Memorandum, and of all appropriate <br />actions taken with respect to such violations. <br />VII. Bonding <br />1. Reclamation bonds will be issued in the name of the State of <br />Colorado and will be held and administered by the CMLRB. <br />2. Bonds will not be released, in whole or in part, until the BLM <br />has advised the CMLRB that the reclamation work has been completed in a manner <br />-- - - satisfactory to the BLM. A provision to that effect will be included in the <br />State bond fore as paragraph 11(c). <br />3. Upon default, the State, to the extent practicable with the <br />proceeds received under the bond, will cause the reclamation work to be <br />per ormed in accordance with the reclamation standards set out in the aoproved <br />clan. <br />
