Rule 6.4.7 Exhibit G -Water Information <br />6. Section (3) of Water Information requires the Applicant/Operator to provide an estimate of the project water <br />requirements including flow rates and annual volumes for development, mining and reclamation phases of the <br />project. If water will be used for any aspect of this proposed operation, please supply the above information. <br />7. Section (4) of Water Information requires the Applicant/Operator to indicate the projected amount from each of the <br />sources of water to supply the projected water requirements for the mining operation and reclamation. If water will <br />be used for any aspect of this proposed operation, please supply the above information. <br />Rule 6.4.8 Exhibit H -Wildlife Information <br />8. Rule 6.4.8 requires the Operator/Applicant to submit wildlife information related to the site and the proposed <br />activity. There does no[ appeaz to be such information contained in the original, 110 application materials. Please <br />submit the required information, containing the specifics described in 6.4.8 sections (1) and (2). <br />Rule 6.4.14 Exhibit N -Source of Leeal Right to Enter <br />9. Rule 6.4.14 requires the Operator/Applicant to submit the source of the Operator's/Applicant's legal right to enter <br />and initiate a mining operation on the affected land. The lease representing the source of legal right to enter <br />submitted with the original 110 application materials has expired. Please submit a current document indicating the <br />Operator's/Applicant's legal right to enter and initiate mining operations at the site. <br />Rule 6.4.15 Exhibit O -Owner(s) of Record of Affected Land (Surface Area) and Owners of Substance to be Mined <br />10. This Rule requires the Operator/Applicant to provide documentation of all owners of record of affected land and <br />owners of the substance to be mined either as a list or on the map in Exhibit C. Please supply this information. <br />Rule 6.4.19 Exhibit S -Permanent Man-made Stmctures <br />11. This rule requires the Applicant/Operator to indicate whether any man-made structures exist within 200 feet of the <br />affected land. If such structures exist, the rule describes the required documentation to allow mining in that azea. <br />Please specify whether there are any man-made structures within 200 feet of the proposed affected land. If such <br />structures exist, please submit the appropriate agreements. <br />Please be advised that the Conejos County 110(c) conversion Application may be deemed inadequate, and the <br />application maybe denied on January 29, 2007 unless the above mentioned adequacy review items aze addressed to the <br />satisfaction o£ the Division. Responses to these adequacy concerns must be received by the Division to allow adequate <br />time for review prior to the decision date. If you feel more time is needed to complete your reply, the Division can <br />grant an extension to the decision date. This will be done upon receipt of a written waiver of your right to a decision by <br />January 29, 2007 and request for additional time. This request must be received no later than January 29, 2007.
