Cattany <br />Division Director <br />Natural Resource Trustee <br />Listed below are adequacy review comments for the La Florida Pit 110(c) Conversion Application, File No. M-1987- <br />097. The Division of Reclamation, Mining and Safety (Division) is required to make a decision by no later than <br />January 29, 2007. Therefore, your response to the following adequacy review concerns should be submitted to the <br />Division as soon as possible. <br />As required by Rule 1.65 (2), please submit the proof of publication of the public notice circulated in the <br />local newspaper and all owners of record of surface lands, and easement holders that are on the affected land <br />and within 200 feet of the boundary of the affected land. Proof of notice may be return receipts of a Certified <br />Mailing or by proof of personal service. <br />2. Rule 6.2.1(2) requires that maps be prepazed and signed by a registered land surveyor, professional engineer, or <br />other qualified person. The maps submitted to the Division were not signed. Please submit the proper, signed <br />maps to the Division. <br />Rule 6.4.3 Exhibit C- Pre Minin¢ and Mine Plan Map(s) of Affected Land <br />3. Rule 6.4.3 requires the Operator/Applicant to submit a pre mining and mine plan map of the affected land. <br />Although the application materials do contain a map that shows an expanded azea to be mined, albeit not to scale, <br />the materials do not appeaz to contain the required map(s). Please submit the required map(s) depicting the <br />features described in Rule 6.4.3 (a) through (i). <br />Rule 6.4.4 Exhibit D- Minin¢ Plan <br />4. Rule 6.4.4 requires the Operator/Applicant to submit a mining plan. The materials submitted do not contain a <br />mining plan nor a reference to the existing plan originally submitted with the original 110 permit application. <br />Please specify whether the existing mining plan pertains to the conversion application or submit a new, updated <br />mining plan to address the operations of the conversion. <br />Rule 6.4.6 Exhibit F- Reclamation Plan Man <br />Section (a) of the Reclamation Plan Map requires the Operator/Applicant to submit a map depicting the expected <br />physical appearance of the area of the affected land, correlated to the proposed mining and reclamation timetables. <br />The map must show proposed topography of the azea with contour lines of sufficient detail to portray the direction <br />and rate of slope of all reclaimed lands. The submitted map and aerial photos appear to depict the site in its current <br />condition and the current permit boundary. The appropriate map must show the proposed permit boundary and the <br />proposed, reclaimed topography of the site.
