Box 39 <br />Hugo, CO 80821 <br />Laboratory Services Division <br />8100 Lowry Blvd. <br />Denver, Colorado 80230-8928 <br />(303)692-3090 <br />ACTION: APEN REQUIRED <br />PERMIT EXEMPT <br />RE: Permit Application No. 04LI1172F, Surface Mining Operation <br />Dear Mr. Blake: <br />The Air Pollution Control Division (the Division) received your permit application no. 04LI1172F for the sand <br />and gravel surface mining operation known as Elmer Stone Pit, located in NW NW Sec 15 T15S R56W, <br />Lincoln County, Colorado. The Division determined no emission permit is required forthe above referenced <br />source since surface mining activities that mine 70,000 tons per year or less are specifically listed as being <br />exempt from permitting requirements (Reference: Regulation No. 3, Part B, Section II.D.1.g.). However, an <br />Air Pollutant Emission Notice (APEN) is required since uncontrolled emissions of particulate matterwill be <br />more than 2 tons peryear (Reference: Regulation No. 3, Part A, Section 11.6.3.a). <br />This exemption from permit requirements is issued in reliance upon the accuracy and completeness of <br />information supplied by the applicant and is conditioned upon construction, installation, and operation in <br />accordance with this information and with representations made by the applicant or the applicant's agents. <br />Specifically, this exemption has been granted provided that the following information is accurate and <br />complete: <br />The production rate does not exceed 70,000 tons per year. Annual records of the actual production <br />rate shall be maintained and made available to the Division for inspection upon request. <br />2. The applicant shall follow the fugitive dust control plan as submitted with the application. <br />The following actual controlled emissions of total suspended particulates (TSP) and particulate matter of <br />less than ten microns (PM,o) are estimated based on the production rates listed on the APEN. This <br />information is listed to inform the operator of the Division's analysis of the TSP and PM,e emissions. This <br />information is listed on the Division's emission inventory system. <br />Fugitive Total Suspended Particuiates: 1.91 tons/year <br />Fugitive Particulate Matter (PMIO): 0.58 tons/year <br />AIRS ID: 073/0070/001 Page 1 of 2 <br />
