Ms. Erica Crosby <br />April 10, 2002 <br />page 2 <br />possible changes to the reclamation contours and location of the reclaimed crest of Pond 3. At <br />this time, Lafarge plans to reclaim Pond 3 to the contours of the DMG-approved reclamation <br />plan, which is consistent with the county Conditional Use Permit. The possible exception to the <br />current plan is that the County may allow Lafazge to reclaim the west wall of Pond 3 in the area <br />in question in the Notice to an offset distance from the centerline of the Brantner Ditch of at least <br />200 feet. This width will still be adequate for the parkway road to the County's future park <br />facilities in the center of the property. Lafarge is very aware of the County's goals for access to <br />the pazk, and has every intension of meeting these goals as part of its reclamation work. If the <br />reclamation limits change with concurrence of the County, Lafazge will submit another <br />Technical Revision. <br />Lafarge has also had discussions with the Secretary of the Brantner Ditch Company regarding <br />Brantner's entering a compensation agreement for permanent man-made structures within 200 <br />feet of the mining limit as provided in DMG Rule 6.4.19. Unfortunately, the Brantner Ditch <br />Board of Directors cannot decide on this issue until their next meeting in early May. As a result, <br />Lafarge cannot supply this agreement prior to the MLRB Boazd meeting on April 24. While <br />Lafazge has no indication Brantner will not enter such an agreement, as a backup, and as <br />necessary to meet the requirements of DMG Rule 6.4.19, we are also in the process of <br />completing a stability analysis that demonstrates that the actual mining limit has not (and will <br />not) adversely impact the ditch. I plan to send this stability analysis to you as soon as possible <br />during the week of April 15. <br />I appreciate yow time in reviewing this Technical Revision.
