This site <br />inspection was requested by Adams County in its letter of concern to the Division on February <br />12, 2002. This TR-1 is submitted in accordance with the Corrective Action presented in the <br />DMG site inspection report. <br />The Notice identifies an area along the west side of the southern-most pit (Pond 3) on the <br />property where mining occurred closer to the Brantner Ditch (located directly west and adjacent <br />to the west boundary of the Mann Lake property) than prescribed by the approved mine plan. <br />On inspection of both the Exhibit C, approved by the Division, and the mining map approved by <br />Adams County in the Conditional Use Permit (both processes took place in 1988), it appears that <br />there is a discrepancy in the required mining offset from the centerline of the Brantner Ditch. <br />Where the offset in the Division-approved plan varies between 250- to 380 feet in the azea in <br />question, Adams County approved (in both the County resolution and in the May 1988 Gravel <br />Mining Lease with Mobile Premix Concrete, Inc.) an offset of 200 feet from the centerline of the <br />ditch. Regardless of this discrepancy, mining did encroach on the 200-foot limit. <br />The enclosed Drawing 1 presents the limits of the actual mining in the area in question on the <br />west side of Pond 3. This area comprises the additional mining area requested in this TR-1. The <br />mining offset from the centerline of the Brantner Ditch varies from approximately 140 to 170 <br />feet. The additional area mined is approximately 5.4 acres. With respect to the mining stages <br />and acres mined presented in the Amendment 1 Application to the DMG permit in 1988, the <br />mineable acres for Stage 4 would increase to 62.40 acres (from 57.00 acres). The total mineable <br />acres for the project would increase to 196.98 acres (from ]91,58 acres). Total affected acres for <br />the project aze unchanged (at 268.51 acres) as the 5.4 acres are within the original affected acres. <br />The Notice also mentions discrepancies with the reclamation plan, however, it must be noted that <br />reclamation of Pond 3 is not yet completed.
